AIThis multidistrict litigation was consolidated in the Southern District of Florida before Judge James Lawrence King in June 2009, bringing together class actions against numerous major banks challenging their practice of manipulating the order of debit card transactions to maximize overdraft fees. Banks including Bank of America, Wells Fargo, JPMorgan Chase, and others were alleged to have resequenced transactions from largest to smallest (rather than chronologically) to deplete account balances faster, generating billions in overdraft fees from consumers who would have incurred far fewer fees under chronological processing. The litigation produced landmark settlements totaling over $1 billion across all defendant banks, including a $410 million settlement with Bank of America that was one of the largest consumer financial protection settlements in history at that time.
