I'd also like to hear the point on air that a former CASINO OWNER who is "President" is now concerned about the "evil" actions of a gambler. |

It looks like after six years of litigation, Elon Musk's lies about SolarCity convinced a Delaware judge. The ruling will almost certainly be appealed.

For the love of all that is holy, Judge Liman forgot to sign the order.
Come on. |

Elon Musk just lost his motion to attempt to quash the SEC's latest round of subpoenas (at least, latest that we know of).
Some highlights...
"Musk may wish it were otherwise, but he remains subject to the same enforcement authority—and has the same means to challenge the exercise of that authority—as any other citizen."
"Indeed, to conclude otherwise would be to hold that a serial violator of the securities laws or a recidivist would enjoy greater protection against SEC enforcement than a person who had never even been accused of a securities law violation."
"Musk points to nothing in the law or the language of the statute that would suggest that Congress intended such a perverse result."
"The incorrigible securities violator could readily buy a form of protection from future investigation."
While this was a fun read, it's a bit worrisome that Judge Liman previously disclosed direct ownership of Tesla, Inc. (TSLA) shares, but hasn't disclosed whether he disposed of those shares. Previously Judge Liman was forced to admit that he ruled on a case involving Costco Wholesale Corporation (COST) while he held Costco stock. Hopefully he learned his lesson.
It's Document 81 at United States Securities and Exchange Commission v. Musk, New York Southern District Court Case No. 1:18-cv-08865-LJL. |
